Employees [and their immediate families (including parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related] ofZoCo Productions, LLC, Harpo Inc. and Sony (collectively, the “Sponsors”) and of Reach Media Inc (“RMI”), and their respective parents, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win.  By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsors, which are binding and final on matters relating to this Contest.  Contest is subject to all applicable federal, state and local laws.  

The Contest begins at 5:00 a.m. Central Time (“CT”) on November 1, 2010 and ends at 7:00 a.m. CT on November 1, 2010 (“Contest Period”).  To enter, you must text the keyword “OZ” to 646464 between 5:00 a.m. CT and 5:59 a.m. CT.  Entrants will receive a returned message containing a request for information and instructions regarding how to submit an official entry, including an essay of one thousand five hundred (1500) words or less describing why you consider yourself Dr. Oz’s Biggest Fan, via email to an email address provided within the returned text message. Mail-in essay submissions will not be accepted or returned.  Limit one (1) entry per person/email address per household per day.  All entries must be received by 5:59 p.m. CT on November 1, 2010 to be eligible. Entries generated by script, macro or other automated means are void.  All essay entries become the property of Sponsors and will not be acknowledged or returned.  By submitting an essay, each entrant represents and warrants that they own the copyright in and to such essay and further grants Sponsors the non-exclusive right to use that essay (or any portion thereof) for unlimited runs, worldwide, in perpetuity in any and all media now known or hereafter devised in connection with the Contest and/or the “Dr. Oz Show” or any other programming (including television, digital download, radio) created by Sponsors and the marketing, advertising and promotion thereof. 

SELECTION:  The potential Contest winner (“Winner”) will be selected, at the sole discretion of Sponsor, on or about November 1, 2010 from all eligible entries received.  Entries will be judged on originality, composition and overall impact. The judges are a panel of Sponsor staff members.  Odds of winning depend on the number of eligible entries received.  The potential Winner will be announced on RMI’s syndicated radio program “The Tom Joyner Morning Show” and notified by phone, or email and may be required to execute and return an affidavit of eligibility, proof of identity, a liability release and, where lawful, a publicity release within twenty-four (24) hours of notification. If such documents are not returned within the specified time period, prize or prize notification is returned as undeliverable, potential Winner is not in compliance with these rules, or Sponsors are unable to contact a potential Winner within the designated time period, prize will be forfeited and, at Sponsors’ sole discretion, an alternate Winner may be selected. 

Prize:Prize includes a trip (“Trip”) for the Winner and one (1) guest accompanying Winner (individually and collectively, “Attendees”) to travel to New York, New York to attend a special taping of “The Dr. Oz Show.”  At the sole discretion of Sponsor and provided Winner’s principal residence is more than one hundred (100) miles from New York, NY, the trip may also include roundtrip coach class transportation by air, train, bus or car from a major city closest to Winner’s principal place of residence to New York; hotel accommodations (room and tax only) for up to two (2) days/one (1) night; and ground transportation while in New York City. All matters with respect to the Attendees’ mode of transportation, hotel accommodations and ground transportation shall be determined and selected by Sponsor in Sponsor’s sole discretion.  The Winner must be available and willing to travel to New York, New York on or before December 16, 2010 and to attend a special taping of “The Dr. Oz Show” on December 17, 2010. Sponsor is only responsible for booking return transportation following the taping on or before December 17, 2010.  The Trip is provided to the Attendees only. Sponsor is not responsible for booking travel, hotel accommodations, ground transportation or tickets to “The Dr. Oz Show” taping for more than one (1) guest accompanying Winner to New York. Travel is based on availability, blackout dates apply and some carrier and hotel restrictions may apply.  Trip details are subject to change.  (Approximate Retail Value (“ARV”) of the Trip is $3,000.00 US in the aggregate) depending upon the Winner’s principal place of residence). Attendees are solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, transportation, food, gratuity and hotel charges.  Winner may not substitute, assign or transfer prize, but Sponsors reserve the right, at their sole discretion, to substitute a prize with one (1) of comparable or greater value.  Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. Prize details are at Sponsors’ sole discretion. Limit one (1) Prize per person/email address per household for the entire Contest. 

General Conditions: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes, or in any Contest-related materials.  Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest.  Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the Contest or website or who are in violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all associated entries will be void.  Should any portion of the Contest be, in Sponsors’ sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsors, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsors reserve the right at their sole discretion to suspend, modify or terminate the Contest and, if terminated, at their discretion, select the potential winners from all eligible, non-suspect entries received prior to action taken.  Entrants, by participating, agree that Sponsors,  RMI and their respective parents, affiliates, subsidiaries and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Contest.  Winner, by acceptance of Prize, excepts where legally prohibited, grants permission for Sponsors and their respective designees to use his/her name, address (city and state), photograph, voice and/or other likeness and Prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these rules.  Authorized account subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsors, shall be governed by, and construed in accordance with the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions (whether of Illinois or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Illinois.  The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.  In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

DISPUTES: As a condition of participating, entrant agrees that a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out of pocket expenses, if any, and b) all causes of action arising out of or connected with this Contest, or any compensation or credit to be provided, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and award shall be limited to actual out of pocket costs incurred, if any, and in no event shall entrant be entitled to receive attorneys’ fees or other legal costs or expenses.
